The Real Estate Transactions (Conveyancing) Department
The department deals with Land and Conveyancing transactions including transfers, conveyances, leases, sale agreements and subdivisions.
The department advises on change of user, negotiations of securities such as charges and mortgages
- We act for clients in setting up property schemes for residential and commercial estates including preparation of title documents.
- The firm assist corporate clients in applying for and obtaining titles to land, processing and utilizing such titles to raise finance from lending institutions.
- The firm undertakes registration of mortgages, leases and other encumbrances on land titles, registration of transfers and dispositions of titles in receivership, and other asset securitisations.
- We undertake all aspects of due diligence prior to listing securities, share and asset transfers or sales and lending contracts.
Recent Experience
Public Procurement and Regulation
- Acted on a retainer for Kenya Pipeline Corporation as Lead counsel to defend the Corporation in respect of a complaint filed before the Public Procurement Complaints and Appeals Board in 2004.
- In a dispute involving the supply for new solvent pyrethrum extraction plaint of at least 50TPD, acted for a major International Supplier Messrs DESMET TECHNOLOGIES AND SERVICES N.V/S.A. The appeal was successfully concluded.
- Successfully prepared and argued an Appeal before The Public Procurement Board in January 2006 on behalf of New Baron & Leveque International, a International Consortium in the Tender for the 1.4 Billion new Cement Clinker sought to be sourced by East African Portland Cement Company Limited
- Was retained by a Mumbai-based Steel and Metal parts manufacturer in March 2005 to prepare and argue an Appeal against The Kenya Electricity Generating Company (KenGen) in which the latter had irregularly awarded the supply of metal casings to be used at its Hydro stations to another bidder. The Appeal was successful and new tendering was ordered.
- Has defended Telkom Kenya Limited in a number of Procurement Cases the recent ones include defending the Corporations’ interest in an Appeal filed by a Bidder in a Tender for provisions of various devises for the operation of its Transmission Stations
- Retained by Jacorossi Impresse SPA, of Italy to represent its interest as an Interested Party in an Appeal lodged against the Award of Tender for the Provision of Solid Waste Management for the City Council of Mombasa and Nairobi.
- Other Clients to have acted for include Otis Elevators in a Tender for the Installation of Elevators in the Kenyatta International Conference Centre, Mohammed & Muigai Advocates in a complaint over the cancellation of a World-Bank Funded Tender for Legal Services to Nairobi Water Company Limited and Meditec Pharmaceuticals in a Tender for the Supply of new Radiology Equipment to Kenyatta National Hospital
- Have advised a number of State Corporations including Telkom Kenya Limited, Kenya Power Limited, Kenya Electricty Generating Company on Procurement matters especially on establishing effective procurement department, processes and procedures of Tendering and dispute Resolution arising out of Tendering.
- Currently compiling a Compendium Digest of Procurement Cases and Regulations for use by State Corporations, other Government Agencies, Private Firms and Procurement Practioners.
