The firm is one of the leading firms in the areas of civil/commercial litigation, criminal appeals and arbitration in the region.
  • The department is involved in the day to day litigation before the Court of appeal, the high court, the magistrates courts and Arbitral Tribunals both in Kenya and in the region.
     
  • We provide legal advice and conducts court cases on behalf of a number of commercial entities both private and public within East Africa.
     
  • The department also provides support to the other departments of the firm by taking all necessary court actions including in enforcing securities, loan recoveries, termination of Dealer Agreements and labour disputes.

Recent Experience:

  • We undertake the defense of the leading media companies in the country in all defamation/libel actions.
     
  • The firm acted for Kenya Airports Authority in an Arbitration over dispute over fuel uplift levy with Kenya Pipeline Company Limited by formulating and prosecuting the client’s claim
     
  • The firm has provided legal advice to East African Development Bank on how to resolve a complex Commercial Arbitration and litigation valued at about USD 13 million. In undertaking the brief, the firm prepares and reviews pleadings, submissions and briefs and also attend to Arbitration and court proceedings on behalf of the bank.
     
  • The firm undertook the private prosecution of suspects in matters related to internal fraud committed by employees on behalf of Barclays Bank of Kenya. In connection with the brief, provided legal advice on ways of dealing with the massive fraud, prepared witness statements, pre-trial preparation and attending court for hearings.
     
  • The firm successfully led the legal team advising and defending the Kenya-Anti Corruption Commission in several Constitutional references before the Kenyan HIGH Court filed to challenge the constitutionality of its establishing provisions in the year 2004.
     
  • The firm’s managing partner has been retained as the lead counsel for the Kenya Pipeline Company Limited in a complaint before the Public Procurement Complaints and Appeals Board charged with the responsibility of drafting and presenting the client’s response to the complaint filed in respect of a security tender.
     
  • The firm has also undertaken a number of successful criminal Appeals to the Kenyan Court of Appeal for clients charged with capital offences.
     
  • We are defending a leading media house on claims of Trade Mark infringement arising out of the publication of a popular entertainment magazine.
     
  • We act for four leading banks in the region in a number of suits relating to enforcement of banks’ power of sale under charges and debentures.
     
  • Advise corporate clients on employment issues with respect to termination, redundancy and retrenchment of employees and undertaking litigation arising from subsequent disputes.
     
  • We have successfully challenged in a constitutional reference the right of a litigant to private prosecution during the pendency of a nolle prosequi by the Attorney General.
